L’obiettivo principale di questo lavoro consiste nel sottoporre a verifica critica, alla luce di tematiche e di casi specifici, alcune delle categorie che abitualmente si utilizzano nei ragionamenti giuridici dedicati alle questioni di bioetica. La prospettiva da cui condurre l’analisi – non solo a motivo della formazione personale di chi scrive, come si vedrà subito – non sarà quella della filosofia del diritto, area che finora ha nutrito gran parte della riflessione biogiuridica, ma quella del diritto costituzionale comparato. I principali riferimenti, quindi, non andranno a concetti come verità, bene, natura o verso le teorie dell’utilitarismo, relativismo, neocontrattualismo, principialismo, ecc., ma si rivolgeranno a previsioni costituzionali, a leading cases, a disposizioni normative e ad interpretazioni dottrinali tutte esaminate all’interno di un quadro di riferimento logico-concettuale riconducibile al diritto costituzionale ed al metodo comparato. Il lavoro è stato eseguito con il contributo della Provincia Autonoma di Trento.

Dieser Beitrag untersucht den Toleranzgedanken bzw. seine literarisch-ästhetische Gestaltung in Chaim Potoks Roman 'My Name is Asher Lev'. Die Figur der Toleranz entwickelt Potok darin nicht aus dem Kontrast verschiedener Religionen oder Weltanschauungen, sondern am Zusammenprall traditionskonformer religiöser Praxis und eigenem Lebensentwurf innerhalb derselben (ultraorthodoxen) Religionsgemeinschaft. Die von Potok verwendeten Mitteln, den Toleranzgedanken literarisch zu übersetzen, sind zum einen die Haltungen der Romanfiguren, zum anderen die Stimmungsräume, die den Interaktionen zwischen den Protagonisten den Rahmen verleihen. Die Haltung der Toleranz verkörpert dabei ausgerechnet der geistige Führer der ultraorthodoxen jüdischen Gemeinschaft, der Rebbe. Denn – so die Interpretation – erst aus dem Geist des Monotheismus erwächst Toleranz als positive Haltung und ist nur darin überhaupt möglich.

The present article investigates the correlation between the concepts of lex aeterna, lex naturalis and motus rationalis creaturae in the famous tract De lege in Thomas Aquinas’ Summa Theologiae. The result offers a new comprehension of the notion of natural law, according to which it has to be understood no longer propositionally, i.e. as a list of universally valid norms, but as a performative process in which the bonum in particulari, i.e. the concrete good, dialogically emerges as product of a network of instances. In fact, the ethical good can never be the pure implementation of a general rule; moreover, it is able to bind the will of the acting person only if at the same time it appears as good for him, i.e. for the person who acts here and now. In doing so the ethically acting person realizes himself ontologically becoming the free and creative principle of the own actions.

Il presente articolo intende analizzare l’intima correlazione dei concetti di lex aeterna, lex naturalis e
motus rationalis creaturae nel trattato De lege della Summa Theologiae di Tommaso d’Aquino. Da tale analisi risulta un’altra comprensione del concetto etico fondamentale di legge naturale, e cioè non più come realtà proposizionale, quanto piuttosto come processo performativo in cui il bonum in particulari emerga dialogicamente. Infatti il bene, solo in quanto bonum emergente per l’agente qui ed ora (bonum-per-me), potrà vincolare il volere generico dell’agente al compimento dell’atto etico. In ciò l’agente, proprio in virtù della frammentarietà del proprio motus, diventa performativamente il principio libero e creativo del proprio agire, e, perciò, anche imago Dei.

In the essay 'Donner la mort' (1992) Jacques Derrida develops a new concept for the philosophical category of the subjectivity. In particular, he crucially connects the genesis of the subject with the experience of the absolute responsibility that, for Derrida, also represents the beginning of the religion itself: the religion comes to light fundamentally as history of the responsibility. The symbol of the absolute responsibility is the biblical figure of Abraham in the shocking pericope of Genesis 22, where God demands the sacrifice of Isaac.
This paper aims to analyze the structure of the absolute responsibility as genesis of the subject in Derrida’s reconstruction of the biblical text. The responsibility itself turns out to be the common foundation of those religions that share the figure of Abraham and provides also a base for a philosophy of monotheism.

This contribution aims, on the one hand, to present the results of my research on the structures of the free and creative act in Thomas Aquinas’ ethics, on the other hand, to discuss whether Thomas’ metaphysics can be encompassed as ‘open metaphysics’. In such an approach the first cause is not so much the fundamental rule of human acting, but rather the open space of acting itself in the human being, so that he can be causa sui and, hence, free.
